Determinations

Public sector determinations are issued by the commissioner.

They may include matters that apply generally to all employees, to a specific class of employees or to an individual employee such as:

• temporary employment conditions
• rates for travelling allowance
• special remote locality provisions.

Employment in the Northern Territory Public Sector (NTPS) is governed by Northern Territory and Commonwealth legislation.

The primary laws being the Public Sector Employment and Management Act 1993 and the Fair Work Act 2009 (Cth).

Other legislation applicable to NTPS employment includes:

• Anti-Discrimination Act 1992
• Information Act 2002
• Care and Protection of Children Act 2007
• Public Holidays Act 1981
• Independent Commissioner Against Corruption Act 2017
• Return to Work Act 1986
• Work Health and Safety (National Uniform Legislation) Act 2011.
