Bulletin 24 - NTPS 2021-2025 enterprise agreement is now approved - issued 7 February 2022
After the success of the ballot outcome last December, I am very pleased to advise that the Fair Work Commission approved the Northern Territory Public Sector 2021 – 2025 Enterprise Agreement (the Agreement) on Monday 31 January 2022.
In accordance with the Fair Work Act 2009, the Agreement formally commences on Monday 7 February 2022.
This is an excellent outcome that delivers significant improvements especially in your leave entitlements as well as other conditions in the Agreement. This new Agreement also provides certainty and stability in your terms and conditions for the next four years.
As part of the approval process, the Fair Work Commission requested that the employer confirm that the definition of shiftworkers is in accordance with the National Employment Standards under the Fair Work Act provide an undertaking. This was the intention of the Agreement and a copy of the undertaking can be located on the last page of it.
Lump Sum Payment and re-credit leave taken over Christmas Shutdown
As advised in Bulletin 23 on 12 January 2022, I issued Determination Number 4 of 2021 authorising the advanced payment of the $4000 lump sum in pay 15 (20 January 2022) and implementation of the Christmas Close Down leave for 29 to 31 December 2021 for those employed on the day the ballot closed (17 December 2021).
The majority of eligible employees have also now received their $4000 lump sum payment, which is only payable once. Eligible employees who have not received the advanced payment but are employed on 3 March 2022, Pay 18, will receive the $4000 lump sum payment. This payment is also payable to employees who are on unpaid parental leave, unpaid personal or other leave without pay that is for a period of less than 4 weeks on the date the payment is made.
DCDD have also applied a leave credit to cover the Christmas Closedown period for the majority of eligible employees and are finalising the remaining leave credits.
Implementation of the new agreement
DCDD are working to implement the improved terms and conditions under the Agreement effective from 7 February 2022 into myHR and hope to have all relevant system updates made by the end of February.
A copy of the Fair Work Commission approval decision and the Agreement and undertaking can be found on the OCPE Current Enterprise Agreements website.
Congratulations on securing a comprehensive and improved Agreement. Thank you to all who participated in this process.
