Bulletin 31 - 2021 - 2025 Jacana Energy Enterprise Agreement is now approved - issued 14 July 2022
After the success of the ballot outcome in June, I am very pleased to advise that the Fair Work Commission approved the 2021 – 2025 Jacana Energy Enterprise Agreement (the Agreement) on 13 July 2022.
In accordance with the Fair Work Act 2009, the Agreement formally commences on 20 July 2022.
This is an excellent outcome, that delivers significant improvements to the Performance Development Plan (PDP) Framework and your leave entitlements as well as other conditions in the Agreement. This new Agreement also provides certainty and stability in your terms and conditions for the next four years.
As part of the approval process, the employer provided the following undertakings:
- confirm that the definition of shift workers is in accordance with the National Employment Standards under the Fair Work Act 2009;
- ensure employees deemed to have abandoned their employment will be afforded the minimum notice of termination entitlement as per section 117(3) of the Fair Work Act 2009; and
- provide the correct 2022 rates for allowances mentioned under Schedule 2 of the Agreement.

Lump Sum Payment
As advised in Bulletin 30 on 23 June 2022, I issued Determination 1047 of 2022 to enable employees to receive the first payment of the $4000 lump sum in pay 26 (23 June 2022).
The majority of eligible employees have now received their $4000 lump sum payment, which is only payable once. Eligible employees who have not received the advanced payment but are employed on 20 July 2022 will receive the $4000 lump sum payment in pay 3 (4 August 2022). This payment is also payable to employees who are on unpaid parental leave, unpaid personal or other leave without pay that is for a period of less than 4 weeks on the date the payment is made.
The second pay of the $2000 lump sum will be paid in pay 3 (4 August 2022).
Implementation of the new Agreement
DCDD are working to implement the improved terms and conditions under the Agreement effective from 20 July 2022 into myHR and hope to have all relevant system updates made as soon as possible.
